1. Legal Age Certification

By accessing this website or placing an order, you represent and warrant that:

  • You are at least twenty-one (21) years of age.
  • The recipient of the alcohol is at least twenty-one (21) years of age.
  • You will not permit access to, transfer, or provide alcohol purchased through this website to any person under twenty-one (21).
  • All information provided to verify age and identity is truthful and accurate.

Farr Better Spirits II, Inc. relies on these representations as a material condition of sale. Any misrepresentation of age constitutes a material breach of this Agreement. Valid government-issued identification may be required at the time of delivery. Orders may be refused if age verification cannot be completed.

2. Condition of Sale — Adult Signature Required

All alcohol shipments require adult signature upon delivery. Title and risk of loss transfer only upon lawful delivery to a verified adult recipient. If a purchaser circumvents delivery safeguards — including redirecting shipments, leaving instructions that bypass signature verification, or otherwise facilitating unlawful access — all liability shifts exclusively to the purchaser.

3. Assumption of Risk and Release

Alcohol is an inherently regulated product that carries health, safety, and legal risks. To the fullest extent permitted by law, purchaser:

  • Assumes all risks associated with possession, storage, transportation after delivery, consumption, gifting, and resale (where lawful) of products.
  • Releases and discharges Farr Better Spirits II, Inc., Coast Highway Liquor, and their respective officers, directors, shareholders, employees, contractors, agents, suppliers, manufacturers, distributors, and affiliates from any and all claims arising out of misuse, unlawful possession, unlawful furnishing, overconsumption, or illegal conduct of any third party after lawful delivery.

This release does not apply to non-waivable statutory rights or claims arising solely from proven gross negligence or willful misconduct.

4. Limitation of Liability

To the maximum extent permitted by applicable law, the total aggregate liability of Farr Better Spirits II, Inc., Coast Highway Liquor, and all affiliated parties for any claim arising out of or relating to any product purchased through this website shall not exceed the amount actually paid for the specific product giving rise to the claim.

Under no circumstances shall Farr Better Spirits II, Inc. or any affiliated party be liable for:

  • Indirect damages
  • Incidental damages
  • Consequential damages
  • Special damages
  • Exemplary damages
  • Punitive damages
  • Loss of profits
  • Emotional distress
  • Personal injury arising from misuse or unlawful possession
  • Third-party claims arising from unlawful use or transfer

This limitation applies regardless of legal theory — contract, tort, negligence, strict liability, or otherwise — except where such limitation is expressly prohibited by law.

5. Third-Party Possession and Illegal Transfer

Purchaser agrees that Farr Better Spirits II, Inc. shall bear no responsibility for:

  • Any damages arising from alcohol obtained through theft, fraud, misrepresentation, or unauthorized access.
  • Any claim arising from a third party who obtains the product illegally.
  • Any injury or damage occurring after lawful adult delivery.

Purchaser expressly agrees to indemnify and defend Farr Better Spirits II, Inc. against any claim arising from unlawful transfer, gifting, resale, or provision of alcohol to a minor or prohibited person.

6. Indemnification

Purchaser agrees to indemnify, defend, and hold harmless Farr Better Spirits II, Inc., Coast Highway Liquor, and all affiliated persons and entities from and against any and all claims, liabilities, damages, losses, fines, penalties, costs, and attorneys’ fees arising out of:

  • False age representation
  • Violation of alcohol laws
  • Redistribution of alcohol
  • Chargebacks involving misrepresentation
  • Any claim by a third party resulting from purchaser’s actions

This obligation survives termination of the transaction.

7. Title and Risk of Loss

Title and risk of loss transfer to the purchaser upon lawful delivery to the verified adult recipient at the delivery address. Farr Better Spirits II, Inc. is not responsible for any loss, theft, or misuse occurring after lawful delivery has been completed.

8. No Dram Shop Liability Representation

Purchaser acknowledges that Farr Better Spirits II, Inc. does not furnish alcohol for on-premises consumption and does not supervise consumption. Purchaser assumes full responsibility for lawful and responsible use after delivery. Nothing herein creates liability where none exists under applicable law.

9. Compliance With Shipping Laws

Purchaser is solely responsible for ensuring that purchase and receipt of alcohol complies with all applicable local, state, and federal laws in their jurisdiction. Orders may be refused, canceled, or refunded if shipment to a particular jurisdiction is restricted or violates federal, state, or local law.

10. Disclaimer of Warranties

Except where prohibited by law, all products are provided “AS IS” without warranties of any kind, express or implied, including but not limited to merchantability or fitness for a particular purpose. Nothing in this section excludes non-waivable consumer rights.

11. Arbitration and Class Action Waiver

Any dispute arising from use of this website or purchase of products shall be resolved by binding arbitration in the State of California, in accordance with the rules of the American Arbitration Association. Purchaser waives the right to:

  • Trial by jury
  • Participate in class actions
  • Participate in representative proceedings

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
